1. Purpose of the Corporate Logo Usage Guidelines (Terms of Use)

The Corporate Logo Usage Guidelines (hereinafter "Guidelines"), outline the basic rules governing the use of the Nippon Chemi-Con (hereinafter "the Company") corporate logo (hereinafter "the logo").
When using the logo, please adhere to the provisions stipulated in these Guidelines. The use of the logo shall constitute acknowledgement and agreement to these Guidelines.

2. Ownership rights

All rights (including but not limited to intellectual property rights such as copyrights and trademark rights) concerning the logo shall belong to the Company.

3. Purpose of use

Users may use the logo only when the purpose of use is to introduce the Company or the Company's products and services.

4. Prohibited matters (unauthorized use)

The following matters are prohibited upon the use of the logo.

  1. The use of the logo for any purpose other than the "Purpose of use" set forth in the preceding paragraph.
  2. The modification, editing, or alteration of the logo (including color).
  3. The use of the logo as part of the products, services, trademarks, logo, or company name of another company, or in ways that could be confused with or misconstrued as being associated with the products and services of another company.
  4. The unauthorized use of the logo in ways that would suggest an employment relationship, capital relationship, collaborative relationship or any kind of partnership with the Company.
  5. The unauthorized use of the logo in ways that would suggest official approval, authorization, support or recommendation from the Company.
  6. The use of the logo in a way that would slander the Company or the Company's products and services, or harm the reputation of the Company.
  7. The use of the logo in association with illegal matters, antisocial forces, excessively violent or sexual expressions, expressions that could lead to discrimination, or on mediums containing content in violation of public decency.
  8. Any other uses of the logo that the Company deems inappropriate.

5. User liability

  1. If the Company deems that a user is using the logo in violation of these Guidelines, or if the Company deems necessary, the Company may take actions or measures deemed necessary and appropriate towards the user, including a suspension of use . Furthermore, the Company shall make no compensation for any expenses or damages incurred by the user as a result of said action.
  2. In the event the Company incurs any damages, whether direct or indirect (including legal fees), attributable to the use of the logo by a user (including cases where the Company is issued a complaint by a third party in relation to said use), the user must provide immediate compensation in accordance with a claim for damages issued by the Company.

6. No warranty and indemnity

  1. The Company shall make no guarantees that the logo is free of actual or legal defects (including defects related to safety, reliability, accuracy, integrity, validity, applicability with specified purposes, security, errors, bugs, or rights infringement). Furthermore, the Company shall bear no duty whatsoever to provide the logo free of said defects.
  2. The Company shall bear no liability whatsoever regarding any damages incurred by the user attributable to the logo.

7. Guideline revisions

The Company may, at the Company's own discretion and without any prior notice, revise these Guidelines at any time. Revised Guidelines shall take effect at the point they are posted to the appropriate location on the Company website, and the user's continued use of the logo following said revisions shall be acknowledged as agreement to said revised Guidelines.

8. Governing law and jurisdiction

  1. The laws of Japan shall be applied to the use of the logo.
  2. In the event of any disputes concerning the logo, or disputes between the Company and the user in relation to the logo, the Tokyo District Court shall be the exclusive court of jurisdiction in the first instance.
